Terms of Service for Tonarly

1. Acceptance of Terms

By using Tonarly, you agree to comply with and be bound by these Terms of Service.

2. The app

Tonarly is a vocal pitch monitor and music note identifier for iPhone. You may use it for personal, lawful purposes. You are responsible for using a compatible Apple device and a current supported version of iOS.

The free tier includes daily music note identification and vocal pitch monitoring time, plus every notation and A4 calibration. Optional Tonarly Pro features may be offered through the App Store.

3. In-App Purchases

Tonarly Pro unlocks unlimited note identification, unlimited pitch monitoring, and real-time chord detection. Access is granted through the "pro" entitlement, so weekly, yearly, and lifetime purchases unlock the same features.

Plans currently offered in the app may include:

• Weekly subscription — billed every week until canceled.
• Yearly subscription — billed every year until canceled. A free trial may be offered; the paywall shows the trial length and the price after the trial before you confirm.
• Lifetime purchase — a one-time payment that unlocks Pro without a recurring charge.

The price, currency, billing period, trial length, and renewal terms shown in the App Store purchase sheet control the transaction. Display prices in the app are localized by Apple and may change.

While Pro users have unlimited access to Tonarly features, fair usage policies may apply. To ensure a high-quality experience for all users, rate limits may be implemented if usage significantly exceeds typical patterns. These limits are designed to be generous and should not impact regular usage.

b. Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

c. Free Trial: If offered, free trials give you access to premium features for a limited time. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless cancelled at least 24 hours before the end of the trial period.

d. Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period, and you will continue to have access to premium features until that time.

e. Refunds: Refunds are handled by Apple according to Apple's refund policy. For refund requests, please contact Apple Support directly. We are unable to process refunds for App Store purchases.

f. We reserve the right to change the pricing, subscription terms, or benefits associated with in-app purchases. Any such changes will be communicated through the app or on our website. Changes to pricing will not affect your current subscription period but will apply to subsequent renewal periods.

Restore Purchases reconnects Pro to the Apple Account that bought it. Purchases are tied to that Apple Account and are generally non-transferable.

Apple's Licensed Application End User License Agreement also applies to App Store billing. If these terms and Apple's standard EULA conflict on payment, renewal, or refunds, Apple's terms control those points.

4. Usage Limitations

a. We reserve the right to limit the number of feature requests and may change or terminate our services at any time.

b. IMPORTANT: Tonarly is intended for practice, education, and informational purposes. Note names, cents, frequencies, and chord labels may be inaccurate and should not be relied upon as professional tuning or musical advice.

c. Microphone access is required for note identification, pitch monitoring, and chord detection. You may deny that permission, but those features will not work without it.

5. Intellectual Property

a. All content within Tonarly, including text, graphics, and code, is the property of Mario Saputra and is protected by copyright and other intellectual property laws.

b. You may not reproduce, modify, or distribute any content from our app without our permission.

6. Acceptable use

You may not abuse, disrupt, reverse engineer, cheat, scrape, or attempt to gain unauthorized access to the app or its services. You may not interfere with purchases or another person's use of Tonarly.

7. Privacy

Your use of the app is subject to our Privacy Policy, which outlines how we collect and use your data. By using the app, you also agree to our Privacy Policy. You can review our Privacy Policy at https://www.tonarlyapp.com/appstore/privacy.

8. Termination

We may terminate or suspend your access to the app at any time for violation of these Terms of Service, fraudulent activity, or other conduct that we determine is harmful to other users, us, or third parties. If you are a subscriber, termination will not affect your right to use the app until the end of your current subscription period, unless termination is due to a material breach of these terms.

You may stop using the app at any time by deleting it from your device. If you have an active subscription, you must cancel it through your Apple ID account settings to avoid future charges.

9. Disclaimer of Warranty

We provide the app on an "as is" basis, without any warranties or representations.

10. Limitation of Liability

a. We are not liable for any damages or losses resulting from your use of the app.

b. By using Tonarly, you agree to hold harmless Mario Saputra, its employees, affiliates, and partners from any claims, damages, or expenses arising from your use of the app or any actions taken based on the information provided by the app.

11. Changes to these terms

We may update these terms as Tonarly grows. The updated version will be posted on this page. If a change materially affects an active paid subscription, we will make reasonable efforts to provide notice before it takes effect.
